Under Queensland law, you can provide your neighbour with a notice for overhanging branches and request their removal. If your neighbour doesn’t respond to the notice within 30 days, you may remove them yourself or contact professionals. You can then recover up to $300 from your neighbour to contribute to these costs. You do not have to return the branches including any roots or fruits to your neighbour.
